1. Agreement to Terms

By texting any Harlan phone number or using our website at heyharlan.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by Harlan LLC ("Harlan," "we," "us," or "our").

2. Description of Service

Harlan provides AI-powered assistant services delivered via SMS text messaging. Each assistant ("focus") specializes in a specific domain (such as pet care) and is accessible through its own dedicated phone number. The Service includes:

• AI-powered text conversations about the focus domain
• Structured data tracking (e.g., vet visits, medications)
• Proactive reminders and check-ins via SMS
• A web application for billing and settings management

3. SMS Consent and Communication

By texting a Harlan phone number, you consent to receive recurring automated text messages from Harlan at the phone number you used to contact us. Message frequency varies based on your usage and proactive messaging preferences. Message and data rates may apply.

You can opt out at any time by replying STOP to any Harlan message. After opting out, you will receive one final confirmation message and no further messages will be sent. Reply START to resubscribe. Reply HELP for assistance.

Consent to receive text messages is not a condition of purchase. You may subscribe to the Service through other means if available.

4. Subscription and Billing

Harlan offers a 7-day free trial starting from your first text message. After the trial period, continued access requires a paid subscription at $9.00 per month per focus. Billing is handled through Stripe, Inc.

• You will receive a payment link via SMS before your trial ends.
• Subscriptions renew automatically each month until canceled.
• You may cancel at any time by replying STOP, through the Stripe Customer Portal, or through the Harlan web app at app.heyharlan.com.
• Replying STOP cancels both your SMS subscription and billing.
• No refunds are provided for partial months.

5. Not Professional Advice

Harlan is not a substitute for licensed professionals. The Service provides informational guidance only. Depending on the focus area:

• Pet care: Harlan is not a veterinarian. Always consult your vet for medical decisions, diagnoses, and treatment plans.

Harlan will never provide a diagnosis. For emergencies (difficulty breathing, seizures, poisoning, or other urgent symptoms), contact emergency services or your nearest emergency professional immediately. Do not rely on Harlan in emergency situations.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Send abusive, threatening, or harassing messages
• Attempt to reverse-engineer, exploit, or interfere with the Service
• Use the Service to generate spam or unsolicited communications
• Impersonate another person or misrepresent your identity
• Share your subscription or allow others to use the Service through your phone number

We reserve the right to suspend or terminate your account for violation of these Terms.

7. Intellectual Property

The Service, including its AI models, prompts, branding, and software, is owned by Harlan LLC. You retain ownership of any content you send to Harlan (text messages, photos). By using the Service, you grant us a limited license to process your content solely to provide the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Harlan LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to Harlan in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via SMS or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
